ICC allows Duterte to skip confirmation of charges hearing

The International Criminal Court has granted former President Rodrigo Duterte permission not to personally attend the confirmation of charges hearing scheduled to begin on February 23.


In its decision, Pre-Trial Chamber I approved the request of Duterte’s defense team to hold the hearing in his absence. The confirmation of charges hearing will proceed from February 23 to 27, 2026, even without the former president present.


According to ICC Spokesperson Oriane Maillet,“Today, February 20, 2026, following a request by the defence of Mr. Rodrigo Roa Duterte, Pre-Trial Chamber I of the International Criminal Court decided that the hearing on the confirmation of charges will be held in the absence of the suspect.”


Prosecution Opposed the Request


Earlier, the prosecution opposed Duterte’s request. Deputy Prosecutor Mame Mandiaye Niang argued that there was no sufficient basis to excuse him from appearing at the hearing.


The prosecution emphasized that Duterte’s refusal to recognize the ICC’s jurisdiction, as well as his claim that he was “kidnapped” and that the charges against him were fabricated, were not valid grounds to justify his absence.


It further stressed that Duterte is in proper physical and mental condition to face the court. The prosecution added that health-related issues previously raised had already been ruled upon by the ICC and could not simply be revisited.


According to the ICC, Duterte underwent a thorough medical evaluation by doctors and experts, and the court has ensured measures are in place for his safety and well-being during the proceedings.


“As the panel of experts concluded, unanimously, Mr. Duterte is an unreliable historian in regard to assessment of his health and mental fitness,” the prosecution stated.


The prosecution also argued that Duterte’s claim that he is “old, tired, and weak” does not justify skipping the hearing.


“(H)is reasons to avoid appearing in public are not health related but rather due to his lack of respect for the Court,” the prosecution insisted.


What Happens Next


Duterte is facing charges of crimes against humanity in connection with his anti-illegal drug campaign.


Following the confirmation of charges hearing, the judges will have 60 days to decide whether there is sufficient evidence to move the case forward to trial.
